Each month on this page, Adler Giersch addresses a public question concerning personal injury and the law. When is the right time to contact a personal injury attorney after a collision?

After an automobile collision it is hard enough to keep the basic facts of the collision straight when you are in shock and pain, let alone figure out the legal and insurance issues facing you.   Insurance companies will  try to settle your injury claims as quickly and cheaply as they can – pressuring you  while you are still trying to figure out what medical care you need, how to get your car fixed,  whether or not you can work, and how you are going to get your medical care paid for.

The convoluted language of insurance policies can be hard to understand, and even your own insurance company may not be up front with you in advising you of all your rights and the benefits that may be available to help you. They will likely begin asking for recorded statements and sending you  forms to fill out. They are probably not going to tell you important thing like, you do not have to give a recorded statement to receive benefits and in fact  doing so could hurt your claim down the road, or  that  the other driver’s insurance company cannot require you to fill out forms for them. They may try to force you to take an overall settlement to get your car fixed, when the property damage and your injury claims are separate and should be settled separately.

That is why it is important to contact an attorney  sooner rather than later following your collision for a consultation. While every person does not need to hire an attorney, every person injured in a collision needs to consult with an attorney early in the process. The  consultation  will help  you understand your rights -  to make claims, what those claims are, what the insurance companies can and cannot require you to do, and to figure out what coverage’s apply in your particular situation.

The personal injury recovery specialist attorneys of Adler Giersch PS are available for free initial telephone consultations to those injured in automobile collisions and other injury incidents. Don’t let the insurance companies take advantage of you, or lose your ability to get the care you need.
